1. Terms & Conditions
These terms may vary at Markson Sparks discretion, and will be effective upon posting to the Web Site. You must agree to them, and any current variations to them, each time you make a purchase from us. The term “Markson Sparks” in these Terms and Conditions, refers to all of the Markson Sparks companies, including International Events.

2. Age Restrictions.
Events are for adults 18 years and over, unless otherwise stated.

3. Cancellations, Exchanges or Refunds Policy.
Markson Sparks will cancel and refund your tickets up to 30 days before the start of the event. Within 30 days of the event, Markson Sparks will not cancel, exchange or refund if you change your mind, or you or your guests do not or cannot attend the performance(s) confirmed in your booking, except as required by law or as detailed in these Terms and Conditions.

A contract will be made between Markson Sparks and yourself upon confirmation of your booking. Bookings are confirmed when full payment is received. Confirmation of your booking will be sent to the e-mail address that you provided.

5. Confirmation e-mail
Booking confirmation will be sent by e-mail and will include the event times, ticket specifics and other details of your order. Please advise Markson Sparks if you have not received a confirmation email within 48 hours of booking.

6. Name Change
Name changes are permitted up to 24 hours before the event start time. You may assign your purchase to another person, but you must tell us the name of the intended recipient as part of the order process or using the contact details in your confirmation e-mail. If you do not do this, our privacy policy means that we cannot discuss your purchase with that person and the products or services may not be provided to them. By naming the recipient you give us permission to discuss the details of the booking with that person.

7. Specific seating locations
Some ticket levels such as VIP tickets will include privileged seating. Requests for a particular seating location can be made by contacting Markson Sparks but are not guaranteed.

8. Tickets Dispatch
Some of our events will have physical tickets provided which will be sent out 1 week before the event. Some events are not ticketed and you will be required to provide names for all guests attending. You will be contacted via the email provided with further information once your booking is confirmed.

9. Price Changes
All prices are subject to change without prior notice until your booking is confirmed.

10. Refunds for event cancellation
If an event is cancelled or postponed before it begins we will provide a refund to you. Booking transaction fees are non-refundable.

11. GST
All prices quoted include the Goods and Services Tax (GST).

12. Lost Tickets
If your allocated seating tickets are lost or stolen you must contact Markson Sparks immediately for a replacement.

13. Personal information and privacy
In order to make your booking Markson Sparks will need to gather some personal information such as your name, address, email and phone number. We use Securepay for payments and do not have access to your credit card details at any stage of the process. Markson Sparks will keep your details on our marketing database for any upcoming events that we feel you may be interested in. Should you like to be removed from this database, please contact Markson Sparks.

14. Uncontrollable events
Certain things lie outside Markson Sparks control and many situations are unavoidable or not reasonably predictable. Except as required by law, Markson Sparks is not liable for any loss, inconvenience, damage, additional expense, injury, delay or any other claim in relation to:

a. Changes to event information, programme, performers or performance dates, including the cancellation or rescheduling of events;

b. actions or omissions on the part of independent contractors or others outside of Markson Sparks control, who supply products and services in connection with tickets and ticket packages;

c. unknown or unforeseen defects in any venue, vehicle, device or material used in connection with products sold by Markson Sparks;

d. venue/promoter policies or legal regulations including, but not limited to: dress standards, bans on cameras and recording devices, the responsible service of alcohol and safety regulations; or

e. events which are unforeseeable or not preventable by reasonable diligence on our part including, but not limited to: war, fire, floods, unusually severe weather, acts of God, acts of Government, acts of terrorism, accident, failure of machinery, labour disturbances and acts or omissions of telecommunications and delivery service operators beyond our reasonable control.

15. Unenforceability
These Terms are not intended to limit your mandatory legal rights and should be read as such. If any part of these Terms is held to be invalid, illegal, unenforceable or in conflict with the law of New South Wales it will be disregarded to the extent of its invalidity and the remainder will remain in full force and effect.
